- Primero. Por las razones expuestas en esta sentencia, REVOCAR la sentencia proferida por la Sala de Casacion Laboral de la Corte Suprema de Justicia el seis (06) de marzo de 2003. En su lugar, CONFIRMAR el fallo proferido por la Sala de Casacion Civil de la misma Corporacion el veintisiete (27) de enero de 2003, dentro del proceso de la referencia.
- Segundo. ORDENAR que por Secretaria General se de cumplimiento a lo previsto en el articulo 36 del decreto 2591 de 1991.
