- PRIMERO. REVOCAR la sentencia proferida por la Sala Penal del Tribunal Superior del Distrito Judicial de Manizales, el 23 de octubre de 2000, decision que confirmo la de primera instancia dictada por el Juzgado Penal del Circuito de Riosucio, dentro de la accion de tutela de la referencia. En consecuencia, CONCEDER la tutela, por las razones expuestas en la parte motiva del presente fallo.
- SEGUNDO. DECLARAR la nulidad de todo lo actuado por el Juzgado 1deg Promiscuo Municipal de Supia, dentro del juicio de sucesion de Cesar Augusto Ruiz Rotavista, a partir del dia 27 de enero de 2000, inclusive, y por tanto ORDENAR que se envie el mencionado expediente que contiene el sucesorio de Cesar Augusto Ruiz a la jurisdiccion indigena representada en el Cabildo del Resguardo Indigena de Canamomo y Lomaprieta.
- TERCERO. Por Secretaria librense las comunicaciones indicadas en el articulo 36 del decreto 2591 de 1991.
