- Primero. CONFIRMAR la sentencia de 23 de octubre de 2000, mediante la cual el Juzgado Diecinueve Civil Municipal de Bogotá, resolvió denegar la tutela presentada por la señora MYRIAM TAVERA ACHURY.
- Segundo. REVOCAR la sentencia dictada por el Juzgado Veintitrés Civil del Circuito de Bogotá, de 1º de diciembre de 2000. En su lugar, CONFIRMAR el fallo adoptado por el Juzgado Veintisiete Civil Municipal de la misma ciudad el 19 de octubre del mismo año, que resolvió conceder la tutela interpuesta por el señor ALFONSO ARCESIO GUZMAN PINTO, pero por las razones expuestas en la parte considerativa de esta sentencia.
- Tercero. SEÑALAR expresamente que a SALUD COLPATRIA S. A. E.P.S. le asiste el derecho de repetir lo que pague en cumplimiento del fallo de tutela que se confirma en ordinal segundo, ante la subcuenta respectiva del Fondo de Solidaridad y Garantía del Sistema General de Seguridad Social en Salud (FOSYGA).
- Sexto. ORDENAR que por la Secretaria General de la Corporación, se libren las comunicaciones previstas por el artículo 36 del decreto 2591 de 1991.
