- Primero. REVOCAR la sentencia proferida por la Sala Civil del Tribunal Superior del Distrito Judicial de Cali, el 10 de febrero de 1998, mediante la cual denegó la tutela impetrada.
- Segundo. CONCEDER como mecanismo transitorio la tutela deprecada por Fernando Villegas Toro, en el sentido de amparar sus derechos fundamentales a la seguridad social, a la integridad física, a la salud, a la vida y al trabajo. En consecuencia en el término de 48 horas el ISS Seccional Valle del Cauca deberá reconocer y pagar al peticionario su pensión de invalidez.
- Tercero. Conforme al art. 8 del decreto 2591/91, la tutela que en esta providencia se concede permanecerá vigente durante el lapso del proceso laboral que el demandante deberá instaurar ante la justicia ordinaria, en un término máximo de 4 meses, contados a partir de la notificación.
- Cuarto. LIBRENSE, por la Secretaría General de esta Corporación, las comunicaciones de que trata el artículo 36 del Decreto 2591 de 1991, para los efectos allí contemplados.
