La vulneración de derechos fundamentales se atribuye a la negativa de las entidades accionadas de matricular a un menor de edad en una institución educativa que ofrece jornada sabatina, argumentando que no cuenta con la edad mínima requerida para hacerlo, esto es, 16 años.
La actora, en representación de su hijo, alegó la necesidad de que éste estudiara en dicha jornada, toda vez que vive en zona rural y no cuenta con los recursos para pagar el servicio de transporte diario que necesita, lo cual implica que deba caminar una hora para poder llegar al colegio de horario ordinario en el que estaba matriculado.
La peticionaria informó a la Sala que no estaba interesada en continuar con la acción de tutela, toda vez que había matriculado a su hijo en otro establecimiento educativo.
Luego de constatar que en sede de revisión se presentó una variación sustancial en los hechos que dieron origen a la solicitud de amparo, la Corte decidió declarar la CARENCIA ACTUAL DE OBJETO POR SITUACION SOBREVINIENTE.

DECLARAR la carencia actual de objeto por situación sobreviniente, por las razones expuestas en la parte motiva de esta providencia, en la acción de tutela interpuesta por Ana Elcy Ardila Cubillos en representación de su hijo menor Andrés Mauricio Bermúdez Ardila, contra el Colegio Latinoamericano Andrés Bello y el Municipio de Pitalito - Secretaría de Educación.
