- en nombre del pueblo y por mandato de la Constitución,
- R E S U E L V E :
- Primero. REVOCAR la sentencia del veintitrés (23) de febrero de 1995, proferida por la Sala de Casación Civil de la Corte Suprema de Justicia, por las razones expuestas en esta providencia.
- Segundo. En consecuencia, CONFIRMAR, por las razones expuestas en esta providencia, la sentencia del catorce (14) de diciembre de 1994, proferida por la Sala Civil del Tribunal Superior del Distrito Judicial de Santafé de Bogotá, a través de la cual se resolvió negar la acción de tutela interpuesta por Hortensia Piñeros Ramos y María Rebeca Piñeros Alonso contra el Consejo de Estado.
- Tercero. ORDENAR que por la Secretaría General de esta Corporación, se comunique esta providencia a la Sala Civil del Tribunal Superior del Distrito Judicial de Santafé de Bogotá, en la forma y para los efectos previstos en el artículo 36 del decreto 2591 de 1991.
