- R E S U E L V E
- PRIMERO. REVOCAR la sentencia de diciembre 18 de 1992, proferida por el Juzgado 13 Laboral del Circuito de Santafé de Bogotá.
- SEGUNDO. CONCEDER la tutela solicitada por LUIS FERNANDO GALLEGO SALVADOR, en el sentido de ordenar al Gerente General del Instituto de Seguros Sociales, Sección de Prestaciones Económicas, Seccional Cundinamarca, el pago efectivo de la pensión de invalidez reconocida al petente mediante Resolución 002838 de septiembre 2 de 1992.
- TERCERO. ADVERTIR al Gerente General del I.S.S., Seccional Cundinamarca, que la omisión de pagar oportunamente las pensiones de invalidez reconocidas por la entidad vulnera los derechos fundamentales de los pensionados motivo por el cual deberá emprender las medidas necesarias para garantizar la efectividad de este derecho, so pena de incurrir en las sanciones establecidas en el Decreto 2591 de 1991, sin perjuicio de las responsabilidades que pueden deducirse en su contra en el evento de repetir la omisión que motivó la presente acción de tutela.
- CUARTO. LIBRESE comunicación al mencionado Juzgado con miras a que se surta la notificación de esta providencia, según lo establecido en el artículo 36 del Decreto 2591 de 1991.
