- Primero. REVOCAR las Sentencias proferidas por el Tribunal Superior del Distrito Judicial de Santa fe de Bogota -Sala Laboral-, por el Tribunal Contencioso Administrativo del Valle del Cauca -Seccion Primera-, por el Tribunal Superior de Santa Fe de Bogota -Sala Laboral y por el Juzgado 54 Penal del Circuito, por las razones expuestas en la parte motiva de esta Sentencia.
- Segundo. CONCEDER la tutela a los peticionarios LEONOR MARTINEZ SALDANA, MARINA CALDERON DE CASTRO, JOSE HOOVER HERRERA MONTOYA Y AFRANIO PRIETO VILLALOBOS en el sentido de ORDENAR a la Caja Nacional de Prevision -Subdireccion de Prestaciones Economicas-, que sean incluidos en la nomina de pensionados a fin de que entren a disfrutar efectivamente de sus respectivas pensiones.
- Tercero. NEGAR la solicitud de tutela en lo relativo a las pretensiones de mayor valor de las pensiones de jubilacion, controversia esta sobre derechos sustanciales que debe ser resuelta por los jueces competentes.
- Cuarto. A traves de la Secretaria General de la Corte Constitucional, ENVIAR copia de esta Sentencia a los Tribunales y Juzgados de origen, a la Direccion General y la Subdireccion de Prestaciones Economicas de la Caja Nacional de Prevision Social, a la Consejeria para la Modernizacion del Estado de la Presidencia de la Republica y al Defensor del Pueblo.
