- PRIMERO. REVOCAR el fallo proferido el 8 de octubre de 2001 por el Tribunal Superior del Distrito Judicial de Bogota, por medio de la cual se nego el amparo al Senor Carlos A. y en su lugar, CONCEDER la tutela transitoria de sus derechos fundamentales a la vida y la seguridad social.
- SEGUNDO. ORDENAR a BBVA HORIZONTES PENSIONES Y CESANTIAS, que en el termino de veinticuatro (24) horas, contadas a partir de la notificacion de esta providencia, si no lo ha hecho todavia, expida un oficio informando al senor Carlos A. su decision formal relativa al reconocimiento de la pension de invalidez.
- TERCERO. COMPULSAR copias de la presente sentencia al Ministerio de Trabajo y Seguridad Social para que investigue el cumplimiento de las obligaciones legales de TREIN Ltda. como Empresa de Servicios Temporales.
- CUARTO. ADVERTIR al actor que si dentro del termino maximo de cuatro meses contados a partir de la notificacion del presente fallo no instaura una accion ordinaria que resuelva de manera definitiva su situacion, se aplicara lo establecido por el articulo 8 del Decreto 2591 de 1991.
- QUINTO. Por Secretaria General, librense las comunicaciones de que trata el articulo 36 del Decreto 2591 de 1991.
