- Primero. REVOCAR la sentencia proferida por el Juzgado 18 Civil del Circuito de Bogotá, y en su lugar CONCEDER de manera transitoria la tutela de los derechos fundamentales invocados por Faisule Santos Rodríguez y los de su hijo por nacer.
- Segundo. ORDENAR al representante legal de la empresa Perfumes y Cosméticos Internacionales S.A. que dentro de las cuarenta y ocho (48) horas siguientes a la notificación de esta sentencia, reintegre a la señora Faisule Santos Rodríguez, si ella lo desea, al empleo que ocupó hasta ser irregularmente despedida o a uno similar sin solución de continuidad, y se le cancelen los salarios y las prestaciones sociales causadas y no pagadas, desde el momento en que fue desvinculada de sus labores hasta que se produzca el reintegro.
- Tercero. ADVERTIR a la actora que dentro del término máximo de cuatro (4) meses contados a partir de la notificación del presente fallo instaure una acción ordinaria que resuelva de manera definitiva el presente caso, de acuerdo con lo establecido por el artículo 8º. del Decreto 2591 de 1991.
- Cuarto. El desacato de esta sentencia será sancionado como lo prevé el artículo 52 del Decreto 2591 de 1991.
- Quinto. Dar cumplimiento a lo previsto en el artículo 36 del Decreto 2591 de 1991.
