- En merito de lo expuesto, la Corte Constitucional
- R E S U E L V E :
- Primero. ESTARSE a lo resuelto en la sentencia C-663 de 1996 que declaro exequible el articulo demandado, pero solo en cuanto no desconocio el derecho a la autonomia y al libre desarrollo de la personalidad de los trabajadores independientes con capacidad de pago.
- Segundo. ESTARSE a lo resuelto en la sentencia C-112 de 1998 que declaro exequible la frase que seran financiados en su totalidad por el afiliado con recursos distintos a las cotizaciones obligatorias previstas en el articulo 204 de la presente ley del articulo 169 de la Ley 100 de 1993.
- TERCERO. Declarar EXEQUIBLE la expresion Las Entidades Promotoras de Salud podran ofrecer planes complementarios al Plan Obligatorio de Salud del articulo 169 de la Ley 100 de 1993.
