Demanda de inconstitucionalidad contra el artículo 1637 (parcial) del Código Civil Colombiano.
Según los demandantes, la expresión acusada vulnera el derecho fundamental a la igualdad entre hombres y mujeres, al igual que el principio de la no discriminación.
Igualmente consideran, que va en contravía de las metas teleológicas de la jurisprudencia en relación con la protección de la mujer y la erradicación de tratos desiguales de grupos y sectores tradicionalmente marginados.
La Corte decide INHIBIRSE de emitir un fallo de fondo respecto de la disposición normativa acusada, por encontrarse la misma derogada.
