Demanda de inconstitucionalidad contra los artículos 2000 y 2497 del Código Civil y 1033 y 1199 del Código de Comercio.
El demandante considera que las disposiciones cuestionadas vulneran los artículos 1°, 11, 46 y 49 de la Constitución Política.
En consecuencia, solicitó la declaratoria de exequibilidad condicionada, en el entendido de que el acreedor no podrá retener bienes relacionados con la salud del deudor bajo ningún concepto o, en su defecto, que la Corte fije la debida interpretación y aplicación constitucional mediante la redacción de un condicionamiento acorde.
La falta de certeza, especificidad, pertinencia y suficiencia del cargo propuesto llevó a la Sala Plena de la Corporación a declararse INHIBIDA para emitir pronunciamiento de fondo, por la ineptitud sustantiva de la demanda.
