Primero. LEVANTAR la suspensión del término decretada para decidir el presente asunto.
Segundo. CONFIRMAR el fallo proferido por la Sala de Casación Civil y Agraria de la Corte Suprema de Justicia, del 4 de Junio de 2003, que revocó la sentencia Marta de la Sala Civil - Familia del Tribunal Superior del Distrito Judicial de Santa, del 20 de Marzo de 2003, y tuteló el derecho de petición.
Tercero. DECLARAR la carencia actual de objeto, por la razón señalada en la parte motiva de esta providencia.
Cuarto. ORDENAR que por la Secretaría se de cumplimiento a lo dispuesto en el artículo 36 del Decreto 2591 de 1991.
