- PRIMERO. CONFIRMAR por las razones expuestas en la parte motiva de esta sentencia, el fallo proferido por el Juzgado
- Sexto. Civil del Circuito, Cúcuta, el día 10 de junio de 2003 dentro de la acción de tutela instaurada por Luis Hernando Flórez Montaño en contra la Caja Nacional de Previsión social.
- SEGUNDO. ADVERTIR a la Caja Nacional de Previsión Social, que si no ha proferido decisión de fondo en relación con la solicitud de pensión radicada por el señor Luis Hernando Flórez Montaño el 10 de febrero de 2003, DEBERÁ dar respuesta a ésta, en el plazo máximo de las cuarenta y ocho (48) horas siguientes a la notificación de este fallo.
- TERCERO. Para los efectos del artículo 36 del decreto 2591 de 1991, el juzgado de origen hará las notificaciones y tomará las medidas conducentes para el cumplimiento de esta sentencia.
