- Primero. REVOCAR el fallo de instancia objeto de revisión, dictado el 28 de febrero de 2001 por el Tribunal Contencioso Administrativo de Sucre, mediante el cual resolvió no tutelar el derecho fundamental de petición al ciudadano LUIS ALFONSO CABARCAS PRASCA.
- Segundo. CONCEDER la tutela del derecho fundamental de petición, quebrantado por la Caja Nacional de Previsión Social. Se ordena, en consecuencia, a la Subdirección General de Prestaciones Económicas de la Caja Nacional de Previsión Social, con sede en Bogotá, que dentro del perentorio término de cuarenta y ocho (48) horas a partir de la notificación de esta providencia, resuelva, si es que aún no la ha hecho, la solicitud de reconocimiento de pensión de gracia demandada por el señor LUIS ALFONSO CABARCAS PRASCA, radicada en esa dependencia bajo el No. 10727/2000 en el Grupo de Control y Reparto desde hace varios meses.
- Tercero. ORDENAR que por Secretaría General se dé cumplimiento a lo previsto en el artículo 36 del decreto 2591 de 1991.
