- Primero. REVOCAR, por las razones expuestas en la parte considerativa del presente fallo, la Sentencia proferida por el Juzgado
- Segundo. Laboral del Circuito de Florencia - Caqueta, el dia 20 de abril de 1999.
- Segundo. CONCEDER la tutela para la proteccion del derecho de peticion del ciudadano Fernando Chico Guarin. En consecuencia, ordenar a la Caja Nacional de Prevision "Cajanal", que en el termino de cuarenta y ocho (48) horas contadas a partir de la notificacion del presente fallo, responda la solicitud de reconocimiento y pago de pension de gracia que le ha formulado el demandante.
- Tercero. SURTASE el tramite previsto en el articulo 36 del Decreto 2591 de 1991.
