- Primero. Revocar la sentencia proferida por el Juzgado
- Séptimo. Penal del Circuito de Santiago de Cali el 22 de agosto de 2000 y, en su lugar, tutelar el derecho de petición de Gustavo Vergara Gómez.
- Segundo. Ordenar al representante legal del Instituto de Seguros Sociales que
- si aún no lo ha hecho, resuelva dentro de las cuarenta y ocho (48) horas siguientes a la notificación de esta providencia, el recurso de reposición interpuesto por Gustavo Guevara Gómez contra la Resolución No. 1821 de 2000 y, en caso de ser procedente, dé trámite al recurso de apelación interpuesto de manera subsidiaria.
- Tercero. Prevenir al Instituto de Seguros Sociales para que no vuelva a incurrir en esta clase de dilaciones injustificadas en el trámite de las actuaciones administrativas de su competencia, so pena de las sanciones previstas en el Decreto 2591 para el desacato.
- Cuarto. Por Secretaría, líbrese la comunicación prevista en el artículo 36 del Decreto 2591 de 1991.
