- PRIMERO. CONFIRMAR el fallo del Tribunal Superior de Santafé de Bogotá, Sala Penal, proferido el diecisiete (17) de marzo de mil novecientos noventa y tres (1993), en cuanto concedió la tutela del derecho de petición y no tuteló el pretendido derecho a la tranquilidad impetrado por los accionantes.
- SEGUNDO. ORDENAR al Alcalde Menor de Engativa para que en los términos legales, tramité y responda los escritos presentados por los vecinos del barrio "Normandía Sector I", respecto al funcionamiento del establecimiento "Tienda Baco 2000", e igualmente, adopte las medidas adecuadas que garanticen la tranquilidad pública, como también el funcionamiento del establecimiento mencionado, en cuanto ello sea permitido, conforme a las normas legales y reglamentarias correspondientes.
- TERCERO. ORDENAR que por Secretaría de esta Corporación, se envíe copia auténtica de la presente sentencia al señor Personero Distrital, para que que dentro del ámbito propio de su competencia, vigile el cumplimiento de las decisiones adoptadas en la misma.
- CUARTO. LIBRAR comunicación al Juzgado Setenta y cuatro (74) Penal del Circuito de Santafé de Bogotá, a efectos de que notifique esta sentencia a las partes y adopte las decisiones necesarias para la realización de lo aquí dispuesto.
