- Primero. REVOCAR el fallo proferido el 28 de marzo de 2000 por el Juzgado Diecinueve Penal Municipal de Cali y, en su lugar, CONCEDER la tutela para la protección del derecho fundamental de petición del señor Armando Escobar Potes.
- Segundo. ORDENAR al Gerente del Centro de Diagnóstico Automotor del Valle Ltda., que en el término de cuarenta y ocho (48) horas contadas a partir de la notificación de la presente providencia, proceda a suministrar al actor la totalidad de la información solicitada mediante petición del día 21 de febrero de 2000, limitándose, exclusivamente, a reservar aquellos datos respecto de los cuales exista expresa reserva legal y debiendo informar al peticionario el acerca del contenido general de los datos reservados, así como la norma que autoriza la respectiva reserva a fin de que pueda, si lo considera procedente, interponer los recursos del caso.
- Tercero. PREVENIR a la empresa accionada para que actúe en los estrictos términos de la Constitución y la ley, y, en consecuencia, se limite exclusivamente a mantener en reserva el dato protegido sin que pueda utilizar esta atribución para seguir vulnerando los derechos fundamentales del actor.
- Cuarto. Por Secretaría, líbrese la comunicación prevista en el artículo 36 del Decreto 2591 de 1991.
