- Primero. REVOCAR la sentencia proferida por el Juzgado
- Primero. Civil del Circuito de Envigado (Antioquia). En su lugar TUTELAR, el derecho fundamental de peticion de la senora MYRIAM ESTELA RIOS GALLEGO.
- Segundo. ORDENAR al GOBERNADOR DE ANTIOQUIA - SECRETARIA DE EDUCACION Y CULTURA, para que en el plazo maximo de quince (15) dias a partir de la notificacion de la presente sentencia, de respuesta de fondo a la peticion elevada el dia 26 de octubre 2001 por la aqui tutelante.
- Tercero. ADVERTIR a dicha autoridad, que no podra negar o condicionar - aunque sea momentaneamente- el derecho al reconocimiento del ascenso en el escalafon docente a la disponibilidad presupuestal, por las razones que se consignan en la parte motiva de esta sentencia.
- Cuarto. Por Secretaria General, librese la comunicacion de que trata el articulo 36 del decreto 2591 de 1991.
