- Primero. REVOCAR la sentencia proferida el 4 junio del 2003 por la Sala de Casacion Laboral de la Corte Suprema de Justicia, que confirmo la sentencia proferida el 6 de mayo del 2003 por la Sala de Casacion Civil de la Corte Suprema de Justicia, que denego el amparo solicitado por CARLOS HUMBERTO CANAS RIVERA contra la Sala Civil Familia del Tribunal Superior de Tunja, por las razones expresadas en esta providencia.
- Segundo. ORDENAR al Tribunal Superior del Distrito Judicial de Tunja - Sala Civil Familia que en el termino de 10 dias proceda a proferir una nueva sentencia, en la que se tenga en cuenta la prueba relativa a la garantia de cumplimiento del contrato que obra en el expediente.
- Tercero. Por Secretaria, librese la comunicacion prevista en el articulo 36 del Decreto 2591 de 1991.
