- Primero. REVOCAR la sentencia de instancia proferida por el Juzgado Promiscuo Municipal de Polonuevo (Atlántico), el mayo 14 de 2003, y en su lugar, TUTELAR el derecho de petición de Pedro Algarín Ortega.
- Segundo. ORDENAR a la Empresa Electricaribe, Zona Atlántico, que en el término de cuarenta y ocho (48) horas contadas a partir de la notificación de este fallo, responda la petición que elevare el accionante el 10 de marzo de 2003, la cual deberá contener una respuesta de fondo acerca de la solicitud de reparo del electrodoméstico referido, y, en caso de ser dicha respuesta positiva, indicar la fecha y la forma en que la reparación se llevará a cabo.
- Tercero. Por Secretaría líbrese la comunicación prevista en el artículo 36 del Decreto 2591 de 1991.
