- Primero. REVOCAR por las razones expuestas en este Fallo, la Sentencia proferida el veinte (20) de febrero de 2004 por el Juzgado
- Sexto. Civil Municipal de Ibague, y en su lugar, amparar los derechos a la salud en conexidad con la vida, de la senora Maria Josefa Carvajal Agudelo.
- En consecuencia, ORDENAR a la Alcaldia Municipal de Ibague, que a traves de las autoridades y entidades correspondientes, practique INMEDIATAMENTE la cirugia de tumor cerebral ordenada a la accionante, en los terminos expuestos en la parte motiva de esta providencia. Para el efecto debera asumir el 100% del costo de la intervencion.
- Segundo. Librese la comunicacion prevista en el articulo 36 del Decreto 2591 de 1991.
