Primero. REVOCAR parcialmente, la sentencia proferida el 3 de abril de 2003, el Juzgado
Primero. Civil Municipal de El Espinal. En su lugar. TUTELAR los derechos fundamentales de los ninos y a la seguridad social, de la accionante y sus beneficiarios.
Segundo. ORDENAR al Municipio de El Espinal para que dentro de las cuarenta y ocho (48) horas siguientes a la notificacion de la presente sentencia, pague a la Caja de Compensacion Familiar del Sur del Tolima CAFASUR, los dineros correspondientes al subsidio de los meses de enero, febrero y marzo del presente ano, adeudados a la senora Gavilan Amaya.
Por su parte, CAFASUR, tan pronto como reciba los dineros del Municipio de El Espinal, debera pagarlos a la accionante en un plazo maximo de cuarenta y ocho (48) horas.
Respecto de los demas subsidios familiares reclamados por la actora, esta podra iniciar las acciones legales ordinarias contra el municipio de El Espinal, para lograra su efectiva cancelacion.
Tercero. Por Secretaria librese la comunicacion de que trata el articulo 36 del Decreto 2591 de 1991.
