Encuentra la Sala que la disposición contentiva del requisito de fidelidad al sistema fue expulsada del ordenamiento jurídico, por lo tanto no se tiene la posibilidad de aplicarla, y su cumplimiento no puede ser exigido a los beneficiarios.

- Primero. REVOCAR la sentencia del Juzgado Catorce civil Municipal de Barranquilla y, en consecuencia, CONCEDER por las razones antes expuestas el amparo solicitado.
- Segundo. ORDENAR que en el termino de diez (10) dias habiles, contados a partir de la notificacion de la presente sentencia, Porvenir S.A. determine si concede la pension de sobrevivientes a la senora Zulys Esther Suarez Henriquez y a sus supuestas hijas Celena Cecilia Chiquillo Suarez y Clara Ines Chiquillo, en cuanto beneficiarias del senor Jose Maria Chiquillo Reyes, sin que para ello tenga en cuenta el requisito del literal b) del
- articulo 12 de la ley 797 -declarado inconstitucional por la sentencia C-556 de 20 de agosto de 2009-.
- Tercero. Por Secretaria librese la comunicacion prevista en el articulo 36 del Decreto 2591 de 1991.
