- Primero. REVOCAR el fallo de tutela de fecha mayo 03 de 2002, emitido por el Juzgado
- Cuarto. Penal del Circuito de Popayán (Cauca), mediante el cual se negó la protección de amparo constitucional invocado por Andrés Felipe Valencia Rivera, y en su lugar se CONCEDE el amparo para proteger los derechos fundamentales del actor, por las razones expuestas en la parte motiva de esta providencia.
- Segundo. DECLARAR que existe carencia actual de objeto por encontrarnos ante un hecho superado, no debiendo impartir orden alguna.
- Tercero. PREVENIR al director de la Cárcel de San Isidro de Popayán, Hernán Tapia Garzón, para que en el futuro se abstenga de comportamientos tendientes a dilatar ordenes de traslado de internos a otros centros de reclusión, tomadas por parte de las autoridades judiciales competentes.
- Cuarto. Por Secretaría, líbrese la comunicación prevista en el artículo 36 del Decreto 2591 de 1991.
