- en nombre del pueblo y por mandato de la Constitución,
- R E S U E L V E
- Primero. Confirmar las sentencias proferidas por la Sala de Decisión Penal del Tribunal Superior del Distrito Judicial Popayán y por el Juzgado
- Quinto. Penal del Circuito de la misma ciudad, de fechas 5 de marzo y 18 de febrero de 2003 respectivamente, que negaron el amparo de los derechos fundamentales a la vida y a la salud del señor Alirio Alberto Melguiso Barrientos, interno en la Penitenciaría Nacional "San Isidro" de Popayán, por las razones expuestas en esta providencia.
- Recomendar a las directivas de la Penitenciaría "San Isidro" de Popayán, que continúen prestando la atención médica que requiere el actor para tratar la enfermedad que padece y que realicen todas las gestiones a su alcance tendientes a lograr el traslado que solicita el actor.
- Segundo. Por Secretaría, líbrese la comunicación prevista en el artículo 36 del Decreto 2591 de 1991.
