- R E S U E L V E
- Primero. REVOCAR el fallo proferido por la Sala Penal Tribunal Superior de Distrito Judicial de Bogotá, por medio del cual negó el amparo solicitado.
- Segundo. CONCEDER el amparo solicitado y, en consecuencia, ordenar al Instituto Penitenciario y Carcelario - INPEC, que dentro del término de las cuarenta y ocho (48) horas siguientes a la notificación de la presente providencia, si no lo ha hecho ya, adopte las medidas administrativas necesarias que garanticen la realización del procedimiento quirúrgico requerido por el señor Oscar Oswaldo Mahecha Burgos, en un plazo no superior a un mes.
- Tercero. Por Secretaría, líbrese la comunicación prevista en el artículo 36 del Decreto 2591 de 1991.
