- Primero. REVOCAR la Sentencia proferida por el Juzgado 24 Penal del Circuito de Medellín, Antioquia, el 15 de marzo de 2004, de acuerdo con las consideraciones de esta providencia.
- Segundo. TUTELAR el derecho a la salud en conexidad con la vida y dignidad humana, invocados por la señora Luz Noemí Cardona Espinal en favor de su hermano Carlos Arley Cardona Espinal.
- Tercero. ORDENAR al Seguro Social Seccional Antioquia, que en el término de 48 horas a partir de la notificación de la presente sentencia, le suministre al señor Carlos Arley Cardona Espinal la droga "LEPONEX 600 mgr/día, TOFRANIL 150 mgr/día, HALOPERIDOL 20 mgr/día", formulada por su médico tratante.
- Cuarto. AUTORIZAR al Seguro Social Seccional Antioquia, para repetir contra el Fondo de Solidaridad y Garantía "Fosyga" por el monto de los medicamentos suministrados al señor Cardona Espinal, hasta el momento en que se empiece a cancelar efectivamente la pensión de sobrevivientes.
- Quinto. El Desacato a lo dispuesto en el presente fallo se sancionará en la forma prevista en los artículos 52 y 53 del Decreto 2591 de 1991.
- Sexto. Por Secretaria general, líbrense las comunicaciones previstas en el artículo 36 del Decreto 2591 de 1991, para los efectos allí contemplados.
