- Primero. CONFIRMAR el fallo de 9 de enero de 2001 dictado por el Juzgado Treinta y Siete Penal Municipal de Bogotá, en cuanto decidió no tutelar el derecho fundamental invocado, por las razones indicadas en la parte considerativa de la presente sentencia.
