- Primero. CONFIRMAR por las razones expuestas en la parte motiva de esta providencia la Sentencia proferida en segunda instancia por la Sala Penal del Tribunal Superior de Cali, mediante la cual se decidió revocar la sentencia de primera instancia, proferida por el juzgado 14 Penal del Circuito de Cali, y en su lugar negar por improcedente la tutela instaurada.
- Segundo. Por Secretaría, líbrese la comunicación prevista en el artículo 36 del Decreto 2591 de 1991.
