- Primero. CONFIRMAR los fallos proferidos por la Sala Civil del Tribunal Superior de Bogotá el 2º de octubre de 2000, y por la Sala Civil de la Corte Suprema de Justicia el 14 de noviembre de 2000, dentro de la acción de tutela promovida por Luis Enrique Gaviria Otálora en contra del Juzgado 26 Civil del Circuito de Bogotá y del Banco DAVIVIENDA.
- Segundo. LÍBRESE por Secretaría la comunicación de que trata el artículo 36 del Decreto 2591 de 1991, para los efectos allí contemplados.
