El accionante solicita la pensión de sobreviviente o indemnización sustitutiva a que dice tener derecho debido al fallecimiento de su esposa.
La Sala realiza reiteración de jurisprudencia sobre la procedibilidad de la acción de tutela para solicitar el reconocimiento y pago de la pensión de sobrevivientes, se encuentra que el actor dejó transcurrir 13 años desde el fallecimiento de su esposa hasta el momento en que realizó la solicitud de la pensión, por lo tanto la acción no cumple con los requisitos de subsidiariedad ni de inmediatez.

- Primero. CONFIRMAR la sentencia de tutela proferida el tres (3) de diciembre de dos mil nueve (2009), por el Juzgado Cincuenta y Cuatro Penal del Circuito de Bogota, por medio del cual denego la accion de tutela por improcedente, en el proceso instaurado por HERMES LIZARAZO LARGO contra el INSTITUTO DE SEGUROS SOCIALES.
