- PRIMERO. REVOCAR la sentencia de 5 de abril de 1995 proferida por el Tribunal Superior del Distrito Judicial, Sala Laboral, de Cartagena.
- SEGUNDO. CONCEDER, por las razones expuestas en la part motiva de esta providencia, la tutela impetrada y, en consecuencia, se ordena al Director del Fondo de Prevision Social de Bolivar, que, en el termino de un mes, contado a partir de la notificacion de esta sentencia, proceda a efectuar el nombramiento de ROGER DAVILA MORENO como Almacenista, codigo 5030, grado 11, cargo para el cual se presento a concurso publico habiendo ocupado el primer lugar.
- TERCERO. El Juzgado 1o Laboral de Cartagena vigilara el estricto cumplimiento de lo ordenado en este fallo.
- CUARTO. Librense las comunicaciones de que trata el articulo 36 del decreto 2591 de 1991.
