- PRIMERO. REVOCAR la sentencia de marzo 15 de 1995 proferida por el Juzgado Trece Penal del Circuito de Santa Fe de Bogota.
- SEGUNDO. CONCEDER, por las razones expuestas en la parte motiva de esta providencia, la tutela impetrada y, en consecuencia, se ordena al Director del Instituto de Investigaciones en Geociencias, Mineria y Quimica, INGEOMINAS, que, en el termino de un mes, contado a partir de la notificacion de esta sentencia, proceda a efectuar el nombramiento de YOLANDA JULIETA SANABRIA ARTUNDUAGA en el cargo para el cual se presento a concurso publico habiendo ocupado el primer lugar.
- TERCERO. El Juzgado Trece Penal del Circuito de Santa Fe de Bogota vigilara el estricto cumplimiento de lo ordenado en esta providencia.
- CUARTO. LIBRENSE las comunicaciones de que trata el articulo 36 del Decreto 2591 de 1991.
