En el parque automotor de la ciudad de manizales y no se le permite la matricula de un nuevo taxi adquirido en reposicion del automotor retirado aduciendo la secretaria de transito y transporte de la ciudad el congelamiento del parque automotor por incremento medida adoptada por el alcalde mediante decreto 128 de 2006.solicita se ordene autorizar la vinculacion del taxi nuevo en reposicion.caracter subsidiario de la accion de tutela y su improcedencia ante el no ejercicio de los mecanismos de defensa judicial.

En la presente accion de tutela se evidencia un debate netamente legal cuando puede ventilar su inconformidad ante la jurisdiccion contencioso administrativa mediante acciones de simple nulidad nulidad y restablecimiento del derecho e incluso de reparacion directa si estima que le han causado perjuicio patrimonial.negada

- Primero. CONFIRMAR la sentencia proferida por el Juzgado
- Quinto. Penal del Circuito de Manizales el dia 18 de octubre de 2006 en el proceso de la referencia, la cual revoco la decision de primera instancia, y en su lugar desestimo por improcedente la accion interpuesta por la senora Maria Ofelia Castro de Morales contra la Alcaldia de Manizales y la Secretaria de Transito y Transporte de la misma ciudad.
- Segundo. Por Secretaria, librese la comunicacion prevista en el articulo 36 del Decreto 2591 de 1991.
