- Primero. REVOCAR la sentencia proferida por el Tribunal Superior del Distrito Judicial de Bogotá de fecha 28 de noviembre de 2002. En su lugar, TUTELAR los derechos fundamentales a la vida, salud y seguridad social en condiciones dignas y justas, y a la integridad personal del señor Rodrigo Barrera Ochoa.
- Segundo. ORDENAR al Instituto de Seguro Social E.P.S. Seccional Cundinamarca, que en el término de cuarenta y ocho (48) horas, contadas a partir de la notificación de la presente providencia, si aún no lo ha hecho, autorice todos los cuidados médicos, hospitalarios, exámenes especializados y demás procedimientos médicos necesarios como quimioterapia y radioterapia que requiera el demandante.
- Tercero. El Instituto de Seguros Sociales E.P.S. Seccional Cundinamarca, podrá acudir al Fosyga para repetir por el equivalente al número de semanas faltantes, sin que el aludido tratamiento médico pueda ser supeditado a pago alguno por parte del tutelante Rodrigo Barrera Ochoa.
- Cuarto. Por Secretaria General, líbrense las comunicaciones previstas en el artículo 36 del decreto 2591 de 1991, para los efectos allí contemplados.
