- Primero. Revocar la sentencia de fecha 1º de febrero de 2002, del Juzgado Diez y seis Civil del Circuito de Medellín en la acción de tutela presentada por Gonzalo Mesa Acevedo contra la EPS Susalud. En consecuencia, se concede la tutela pedida, para proteger el derecho a la salud en conexidad con el de la vida del demandante.
- Segundo. Para el cumplimiento de la tutela que se concede, se ordena que dentro de las cuarenta y ocho (48) horas siguientes a la notificación de esta sentencia, la entidad demandada, si aún no lo ha hecho, le autorice al señor Mesa Acevedo la prueba de carga viral que le fue formulada.
- Tercero. A la EPS Susalud le asiste el derecho de repetir por lo que pague en cumplimento de este fallo de tutela ante la subcuenta respectiva del Fondo de Solidarida y Garantía del Sistema de Seguridad Social en Salud -Fosyga.
- Líbrense por Secretaría, las comunicaciones de que trata el artículo 36 del Decreto 2591 de 1991.
