- Primero. REVOCAR la sentencia proferida por el Tribunal Administrativo de Santander. En su lugar, TUTELAR el derecho fundamental a la educación del actor.
- Segundo. ORDENAR al Rector del Colegio Cooperativo Integrado La Anunciación del Municipio de Floridablanca, que dentro de las cuarenta y ocho (48) horas siguientes a la notificación de esta sentencia, si aún no lo ha hecho, entregue las certificaciones y notas que requiere el menor Jaime Andrés Espitía.
- Tercero. ADVERTIR a los padres del menor que la procedencia de esta tutela y la orden que se imparte en este numeral, no los exime del cumplimiento de las obligaciones económicas hayan contraído con el Colegio, con quien podrán buscar fórmulas de pago, que en un mediano plazo permita la cancelación de la deuda.
- Cuarto. El desacato a lo ordenado en esta providencia, se sancionará de conformidad con lo señalado en el artículo 52 del decreto 2591 de 1991.
- Quinto. Por Secretaria General, líbrese la comunicación de que trata el artículo 36 del decreto 2591 de 1991.
