Primero. REVOCAR la sentencia del 23 de septiembre de 1998, expedida por la Sala Laboral del Tribunal Superior del Distrito Judicial de Santafé de Bogotá.
Segundo. CONCEDER la tutela del derecho fundamental a la educación de los Menores Fabian Edgardo y Juan Helman Fernández Durán, menores hijos del accionante señor Edgar Octavio Fernández Bustos, quien actúa como su representante. En consecuencia se ordena al Rector del Colegio Externado Caro y Cuervo, que dentro de las cuarenta y ocho (48) horas siguientes a la notificación de este fallo, expida los certificados de los menores, correspondientes al tiempo en que permanecieron en el plantel educativo.
Tercero. ADVERTIR al padre de los menores que la tutela que se otorga no lo exime de la obligación de cancelar lo debido por concepto del servicio educativo prestado a sus hijos por el Colegio Externado Caro y Cuervo.
Cuarto. LÍBRENSE por la Secretaría General de esta Corporación, las comunicaciones de que trata el artículo 36 del decreto 2591 de 1991.
