Primero. REVOCAR la Sentencia dictada por el Juzgado Civil Municipal de la Ceja- Antioquia, el 20 de abril de mil novecientos noventa y ocho(1998)
Segundo. CONCEDER la tutela del derecho fundamental a la educación del menor Lucas Esteban Ochoa . En consecuencia, se ordena al rector del Colegio Salesiano Santodomingo Savio que, si todavía no ha procedido a ello, expida y entregue, dentro del improrrogable término de cuarenta y ocho (48) horas, contadas a partir de la notificación de esta sentencia, las calificaciones correspondientes para que el menor Lucas Esteban Ochoa pueda continuar sus estudios en otro plantel educativo.
Tercero. ADVERTIR a la madre del menor que la tutela que se otorga no la exime de la obligación de cancelar las mensualidades debidas al colegio provenientes de la ejecución del contrato educativo.
Cuarto. COMUNICAR esta providencia al Juzgado Civil Municipal de Ceja - Antioquia , para los efectos contemplados en el artículo 36 del decreto 2591 de 1991.
