- en nombre del Pueblo y por mandato de la Constitución,
- R E S U E L V E :
- Primero. REVOCAR LA SENTENCIA relacionada con la acción de la referencia, proferida por el Juzgado
- Primero. Civil del Circuito de Santa Marta, el 16 de febrero de 1993.
- Segundo. Conceder la tutela solicitada en nombre del menor ALEJANDRO JOSE HUERTAS LINARES, en favor del sus derechos constitucionales a la educación y al debido proceso, desconocidos con ocasión de la sanción que le fue impuesta por el Colegio Ateneo Moderno de Santa Marta.
- En consecuencia, las autoridades del mencionado colegio deben revocar la orden de cancelación del cupo y si aquel menor o sus padres lo solicitan, deberán recibirlo durante el presente año o para el próximo para que adelante el año lectivo que corresponde al
- sexto. de bachillerato; además, estas autoridades y los funcionarios del colegio deberán abstenerse de establecer algún tratamiento discriminatorio que ofenda su derecho a la educación en términos de igualdad con los demás educandos, aun cuando, por otra parte, el Colegio puede hacer cumplir su reglamento con otros mecanismos disciplinarios, por ejemplo con una matrícula condicional.
- Tercero. Comunicar la presente decisión al Rector del Colegio Ateneo Moderno de Santa Marta.
- Cuarto. Comunicar la presente decisión a las Secretarías de Educación de Santa Marta y del Departamento del Magdalena.
- Quinto. Comunicar la presente decisión Juzgado
- Primero. Civil del Circuito de Santa Marta para los efectos de la notificación a las partes, de conformidad con lo establecido en el artículo 36 del Decreto 2591 de 1991.
