- Primero. REVOCAR la sentencia del 11 de septiembre de 1998, expedida por el Juzgado Quince de Familia de Santafe de Bogota.
- Segundo. CONCEDER la tutela del derecho fundamental a la educacion del Menor Luis Sebastian Olarte Quintero. En consecuencia se ordena al rector del Colegio San Viator, reintegrar al menor Luis Sebastian Olarte Quintero y tomar todas las medidas pertinentes y conducentes para que el accionante pueda alcanzar los logros exigidos para el grado
- decimo. (10deg).
- Tercero. ADVERTIR al padre del menor que la tutela que se otorga no lo exime de la obligacion de cancelar lo debido por concepto del servicio educativo prestado a su hijo por el Colegio San Viator.
- Cuarto. Librense por la Secretaria General de esta Corporacion, las comunicaciones de que trata el articulo 36 del decreto 2591 de 1991.
