- PRIMERO. REVOCAR la sentencia proferida por el Juzgado
- Tercero. Civil del Circuito de Santafé de Bogotá D.C., y en su lugar, se dispone conceder la tutela solicitada por el señor José Alvaro Cárdenas, como mecanismo transitorio para evitar un perjuicio irremediable. En tal virtud, el señor José Alvaro Cárdenas podrá continuar disfrutando de la pensión de invalidez otorgada por el ISS, hasta tanto el juez ordinario laboral competente decide si éste tiene derecho o no al pago de dicha prestación económica y de salud.
- SEGUNDO. El señor José Alvaro Cárdenas deberá instaurar el correspondiente proceso laboral dentro de los cuatro (4) meses siguientes a la notificación de la presente sentencia; si así no lo hiciere cesarán sus efectos a partir de la expiración del referido término.
- TERCERO. LIBRAR comunicación al Juzgado
- Tercero. Civil de Santafé de Bogotá D.C., a efecto de que notifique esta sentencia a las partes respectivas y adopten las decisiones necesarias para la ejecución de lo aquí dispuesto.
