PRIMERO. No se accede a declarar la nulidad impetrada por la apoderada del Instituto de Seguros Sociales.
SEGUNDO. Modificar el ordinal 1o. de la parte resolutiva de la sentencia del 28 de febrero de 1994, proferida por el Tribunal Superior del Distrito Judicial de Santa Marta-Sala Laboral, el cual quedará asi:
Con fundamento en el art. 8o. del decreto 2591 de 1991 concédese la tutela impetrada como mecanismo transitorio para evitar un perjuicio irremediable. En tal virtud, el señor Secundino Andrade Yepes podrá continuar disfrutando de la pensión de vejez otorgada por el ISS, mientras el juez ordinario laboral competente decide si éste tiene derecho o no al pago de la referida pensión.
El señor Secundino Andrade Yepes deberá instaurar el correspondiente proceso laboral dentro de los cuatro (4) meses siguientes a la notificación de la presente sentencia; si asi no lo hiciere cesarán sus efectos a partir de la expiración de dicho término.
TERCERO. Confírmase en lo demás la sentencia objeto de revisión.
CUARTO. Ordenar que se libre comunicación al Tribunal Superior del Distrito Judicial de Santa Marta- Sala Laboral para que de conformidad con lo dispuesto por el artículo 36 del decreto 2591 de 1991, notifique esta sentencia a las partes y adopte las decisiones necesarias para adecuar su fallo a lo dispuesto por esta Sala.
