Salud, vida digna.
El accionante actúa en representación de su hijo menor quien sufre de “epilepsia astatomioclónica”, por lo cual se le venía prestando tratamiento de neurología pediátrica en el Instituto Roosvelt, comenta que la EPS accionada se niega a seguirle brindando el tratamiento en dicha institución debido a que ya no hace parte de su red de prestadores de servicios, el actor solicita ordenar a la EPS seguir prestando el servicio requerido en esa entidad.
La Sala se pronuncia sobre, el derecho a la salud como derecho fundamental, la libertad de escoger IPS, facultad de recobro al FOSYGA por parte de la EPS, se concluye que no se encuentra demostrada la incapacidad, imposibilidad, negativa injustificada o negligencia de la EPS para suministrar un servicio a través de sus IPS.
