- Primero. REVOCAR la sentencia proferida por el Juzgado Setenta Civil Municipal de Bogotá. En su lugar, CONCEDER la tutela por violación de los derechos fundamentales a la salud en conexidad con la vida digna.
- Segundo. ORDENAR a la E.P.S. SANITAS que dentro del perentorio término de cuarenta y ocho (48) horas a partir de la notificación personal de esta sentencia, si aún no lo hubiere hecho, suministre al menor Juan Diego Acosta Molina, las vacunas para NEUMOCOCO y VIRUS SINCITIAL RESPIRATORIA, en las cantidades y dosis pertinentes.
- Tercero. SEÑALAR que la E.P.S. SANITAS, podrá repetir contra el FOSYGA lo que desembolse en cumplimiento del presente fallo. Por su parte el FOSYGA dispondrá de quince (15) días para reconocer lo debido o indicar la fecha máxima dentro de la cual lo hará y luego, dará cumplimiento a la obligación reconocida.
- Cuarto. El incumplimiento del presente fallo será sancionado de conformidad con lo establecido por el artículo 52 del Decreto 2591 de 1991, relativo al desacato.
- Quinto. Por Secretaría, líbrese la comunicación de que trata el artículo 36 del Decreto 2591 de 1991.
