- Primero. CONFIRMAR el fallo proferido por el Juzgado 44 Penal del Circuito de Bogotá, pero por las consideraciones aquí expuestas.
- Segundo. PREVENIR al Representante Legal de la Cooperativa Convenios Estratégicos para que bajo ningún supuesto se le cancele la relación laboral a la actora mientras se encuentre en el periodo posterior al parto, fijado por la ley, dada la protección que merece su estado.
- Tercero. ORDENAR al Ministerio de Protección Social para que diseñe, adopte y ejecute, dentro de la órbita de su competencia, un programa que garantice efectivamente los derechos de las personas asociadas a esta clase de cooperativas, y en especial los de las mujeres embarazadas, así como los correctivos necesarios que eviten que estas cooperativas incurran en irregularidades para beneficiarse de las ventajas que ofrece este tipo de trabajo asociado, tendiendo en cuenta el plazo otorgado para tales efectos en sentencia T-1101 de 2001, el cual fue de 6 meses a partir de la ejecutoria de ésta.
- Cuarto. Para el mejor cumplimiento de esta sentencia, por Secretaría General ofíciese lo pertinente al señor Defensor del Pueblo
- Quinto. Dar cumplimiento a lo previsto en el artículo 36 del Decreto 2591 de 1991.
