- PRIMERO. REVOCAR la sentencia de la Corte Suprema de Justicia, Sala de Casación Penal, del 13 de agosto de 2002 y en su lugar CONCEDER la tutela al debido proceso de los menores Gonzalo Andrés y Juan Diego Otavo Fonseca.
- SEGUNDO. DECLARAR la nulidad del auto del 6 de diciembre de 2001 mediante el cual el Juzgado 1º Penal del Circuito de Santa Marta decretó la cesación de procedimiento a favor de Liu Jen Yu, y ORDENAR que notifique a la señora Diana Pilar Fonseca Bolaños, como representante legal de los menores Gonzalo Andrés y Juan Diego Otavo Fonseca, del trámite de cesación de procedimiento por indemnización integral que se adelanta en ese despacho, de manera tal que pueda allegar pruebas para la determinación de los perjuicios, y controvertir las existentes hasta el momento en el proceso, sin perjuicio de las pruebas que el juez solicite de oficio.
- CUARTO. Para los efectos del artículo 36 del decreto 2591 de 1991, el juzgado de origen hará las notificaciones y tomará las medidas conducentes para el cumplimiento de esta sentencia.
